AGREEMENT OF RELEASE AND WAIVER OF LIABILITY I hereby agree to the following: That I am participating in fitness and exercises classes and/or one on one training and/or nutrition coaching with JILLIAN BARNES (here in after referred to as the “studio”) and JILLIAN BARNES (here in after referred to as the “instructor”), during which I will receive information and instruction about fitness training, nutrition and related exercise. I recognize that fitness and related exercise requires physical exertion that may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the fitness classes and/or one on one training. I represent and warrant that I am physically fit and have no medical condition that would prevent my full participation in fitness and one on one training sessions. I agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which I might sustain during or as a result of participating in the fitness and one on one training sessions. In further consideration of being permitted to participate in fitness and one on one personal training sessions, I knowingly, voluntarily, and expressingly waive my claim I may have against the studio and instructor for injury or damages that I may sustain during or as a result of participating in the fitness and one on one training sessions. I, my heirs, or legal representative, forever release waive, discharge and convenant not to sue the studio and instructor for any injury or death caused by negligence or other acts. I agree to let the studio use any photograph and video taken at the studio for any marketing or informational purpose they deem suitable. Over 18 years of age: I have read the above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above. I am 18 years of age or older. 18 years or younger (Parent/Guardian Signature Required): I have read above release and waiver of liability and fully understand its contents. I voluntarily agree to the terms and conditions stated above for the individual listed above.
